Clearway Capital Rejects GZO's Agreement Proposal

On September 7, 2026, Clearway Capital Partners urged creditors to reject GZO AG Spital Wetzikon's proposed composition agreement. Clearway, a leading creditor, plans to vote against the agreement, urging others to do the same at the assembly in October 2026. GZO's plan, involving thurmed AG, offers CHF 70.1 million, covering only 29% of claims, with deferred components extending over ten years and uncertain settlement results.

Clearway criticized GZO for dismissing an alternative, superior Infracore SA offer of CHF 55 million for GZO’s real estate, which could have sustained a 60% recovery. GZO ended the proposal based on PwC's unshared assessment, fostering distrust among creditors. Clearway emphasizes the need for active creditor participation, reminding them that those holding over a third of claims can block the agreement despite the headcount.

The decision reflects concerns about creditor rights, as Clearway accuses GZO of minimizing payouts. They seek to engage creditors ahead of the assembly and explore safeguarding creditor interests from previous decision-making lapses.
